pdfRest™ Terms of Service

pdfRest™ (“Service”) is provided by a division of Datalogics, Inc. 1207 Delaware Ave, Suite 1810,Wilmington, DE 19806-4743 (“Datalogics”) to you, a customer who has registered for the Service through the pdfRest website (“Customer”,”You”).

Definitions

“API Key” means a code generated used to access the pdfRest server.

“API Request” means a communication sent to the pdfRest server for processing.

“Free Service” means a version of the Service which is provided free of charge to Customer for limited usage during the term shown when registering for the Service.

“Confidential Information” means information provided by the Customer or pdfRest to the other party which is not to be shared with third parties without written consent.

“Retention Period” means the amount of time during which the Service stores files submitted.

“Tier of Service” means a version of the Service with a specified number of API Requests selected by the Customer for processing. Tiers of service include Guest, Starter, Premium, Pro, and Enterprise.

Service

Service begins when Customer generates a guest API key or registers an account and continues until the API Key expires. Customer may use the Service for any lawful purpose.

The Service is powered by Adobe® PDF Library™ and Adobe® PDF Converter™.

The Free Service may be terminated at any time, with or without notice, for any reason.

Feedback

You may provide or be asked to provide feedback on the Service for product troubleshooting and enhancement purposes. The email address for such feedback is support@pdfrest.com. Such feedback, along with your company name, may be used in the future promotion of the Service unless you indicate it as Confidential Information.

File Storage

The Retention Period is specified in the Tier of Service for which the Customer account is registered. Retention Period is the time used by the Service to process and the Customer to retrieve the file before removal. Removal takes place automatically after 2 minutes for Guest, 5 minutes for Starter, 30 minutes for Premium, and 30 minutes for Pro. Our Enterprise Customer can customize their retention time.

Scheduled Maintenance Window

As needed, a scheduled maintenance window may be open for up to ten minutes on the second Thursday of each month at 9PM CST. For any work scheduled during this time, all reasonable attempts will be made to avoid and reduce API service interruptions.

Trademarks

pdfRest is a trademark of Datalogics, Inc.

Adobe, Adobe PDF Library, and Adobe PDF Converter are trademarks or registered trademarks of Adobe Systems Incorporated in the United States and other countries.

Datalogics and Customer each grant the other party the right to use its name and company logo for purposes of promoting the Service. Each such use of a trademark will include attribution as required by its respective owner.

Warranty Disclaimer

Datalogics and its suppliers do not and cannot warrant the performance or results you may obtain by using the service.

Limitation of Liability

No Party will be liable for any loss of use, interruption of business, or any indirect, special, incidental, or consequential damages of any kind (including lost profits) regardless of the form of action whether in contract, tort (including negligence), strict product liability or otherwise, even if the other party has been advised of the possibility of such damages.

Governing Law

This Agreement will be governed by and construed in accordance with the substantive laws in force in the State of Illinois.
